Applying for a divorce - Part 2 of 3 Articles (Family Law)

Where can I obtain an Application for Divorce form and where do I file?

• You can obtain a Divorce Application kit at the following link: http://www.federalcircuitcourt.gov.au/wps/wcm/connect/fccweb/forms-and-fees/court-forms/diy-kits/kit-divorce-service
• You can also attend at your nearest Federal Circuit Court Registry to obtain a hard copy of the Forms to complete. The following is a link to your nearest registry: http://www.federalcircuitcourt.gov.au/wps/wcm/connect/fccweb/contact-us/locations
• Through eFiling. You can file an Application for Divorce electronically using a separate interactive online form through the Commonwealth Courts Portal https://www.comcourts.gov.au

If you choose options 1 or 2 above you can file your completed Application by post or hand at your nearest Federal Circuit Court registry.

You will need to file:

• the original and two photocopies of the Application for Divorce and any supporting documents,
• and a copy of your marriage certificate.

You also need to pay a fee or you may be eligible for a fee reduction. You can apply for this by filing an Application for reduction of payment of divorce or decree of nullity form.
